This Intellectual Property Notice applies to all technologies, concepts, branding, artwork, user interface elements, algorithms, and platform mechanisms associated with Shake & Date (“we,” “our,” “us”), including the Shake & Date mobile application, website, and all related features.
1. Ownership of Technology and Concept
All intellectual property associated with the Shake & Date platform is owned exclusively by XtreamData LLC, including but not limited to:
- The Shake-to-Discover™ matching mechanism
- The Radius Matching Engine™ that detects users within proximity
- The real-time “dual activation” connection method
- The user interface designs and user experience flow
- All app screens, animations, layouts, logos, and brand identity
- All visual, written, and interactive elements on the website
- All match-triggering logic and related algorithms
The entire Shake & Date concept, including motion-activated discovery and proximity-based matchmaking, is protected under international copyright, trade secret law, and public timestamp through this published notice.
2. Protection of the Shake-to-Discover™ System
The Shake-to-Discover™ method — which allows users to shake their device to initiate a proximity scan for potential matches — is proprietary intellectual property. This includes:
- The shaking event as a user-initiated match trigger
- Scanning for nearby users within a selected radius
- Notifying both users only when both shake within a shared time window
- The dual-confirmation system that creates a match
No individual, developer, or company is permitted to copy, replicate, reverse engineer, or create derivative versions of this system without written permission.
3. Protection of the Radius Matching Engine™
The Radius Matching Engine™ — which calculates eligibility of matches based on approximate device location and user-selected distance — is a proprietary system owned by XtreamData LLC.
This includes:
- The logic behind proximity filtering
- The real-time location flags required to detect active users
- The search radius dynamic scaling
- The calculation model for mutual discovery
4. Brand and Creative Ownership
All branding elements associated with Shake & Date are protected, including:
- The Shake & Date name and logo
- Color palettes, gradients, glow effects, and theme identity
- App mockups, marketing materials, and promotional assets
- Website layout, visual system, animations, and UI components
These cannot be reproduced or used without authorization.
5. Prohibited Use of Intellectual Property
You may not, under any circumstances:
- Reverse engineer or deconstruct Shake & Date systems
- Copy or clone the Shake-to-Discover™ method
- Develop competing apps using similar shaking or proximity logic
- Replicate branding, UI/UX, animations, or identity
- Use Shake & Date materials for commercial or academic purposes
Violations may result in legal action including damages and injunctions.
6. Public Timestamp and Notice of Rights
This page serves as a public legal timestamp asserting ownership of all Shake & Date intellectual property. Publication of this notice establishes:
- First use in commerce
- Active assertion of proprietary rights
- Public warning against infringement
- Legal evidence of concept ownership
