Welcome to Shake & Date (“Shake & Date,” “we,” “our,” “us”). These Terms of Use (“Terms”) govern your access to and use of the Shake & Date mobile application, website, and all related features or services. By using Shake & Date, you agree to comply with these Terms. If you do not agree, discontinue use immediately.

1. Eligibility

You must meet the following requirements to use Shake & Date:

  • Be at least 18 years of age
  • Have the legal capacity to enter into contracts
  • Not be restricted from using digital services under applicable law

2. Description of the Service

Shake & Date is a real-time proximity-based dating platform that allows users to:

  • Shake their device to activate discovery mode
  • Scan for nearby users within a selected radius
  • Receive notifications when another nearby user shakes
  • Match and communicate through an in-app messaging system

The Shake-to-Discover™ matching system, Radius Matching Engine™, and all associated features are proprietary technologies owned by Shake & Date (XtreamData LLC).

3. Account Registration

Users must create an account to access certain features. You agree to:

  • Provide accurate and truthful information
  • Maintain and update your profile information
  • Not impersonate any person or entity
  • Maintain the confidentiality of your login credentials

4. User Responsibilities & Prohibited Conduct

Users may not engage in the following:

  • Harassment, abuse, stalking, or threatening behavior
  • Uploading illegal, offensive, or harmful content
  • Misusing location features or attempting to deceive others
  • Reverse engineering, copying, or replicating Shake & Date’s technology
  • Creating automated scripts, bots, or scraping tools
  • Using Shake & Date for commercial or promotional activity without permission

5. Intellectual Property Rights

5.1 Ownership

All content, branding, trademarks, designs, algorithms, and technology on the Shake & Date platform—including but not limited to the Shake-to-Discover™ system and Radius Matching Engine™—are the exclusive property of XtreamData LLC.

5.2 Protection of Concept

You acknowledge that the real-time shaking mechanism, proximity detection, and mutual activation process are proprietary and protected under copyright, trade secret, and international IP law.

Recreating or attempting to recreate this functionality is strictly prohibited.

6. License Granted to Users

Shake & Date grants a non-exclusive, revocable, personal license to use the platform for non-commercial purposes. Users may not copy, modify, distribute, or create derivative works from any Shake & Date content or code.

7. Location Services

Shake & Date relies on approximate device location to identify nearby users and deliver match notifications. By using the platform, you consent to the use of location services.

Your precise location is never shared with other users.

8. Messaging & Communication

Matched users may exchange messages via in-app chat. Shake & Date does not monitor conversations unless legally required or necessary to enforce safety guidelines.

9. Safety Disclaimer

Shake & Date does not conduct background checks or guarantee the identity or intentions of users. You are solely responsible for your interactions and in-person meetings.

10. Payments & Subscriptions

Future premium features may require subscription or payment via Apple App Store or Google Play. Refund policies follow the rules of those platforms.

11. Termination

We may suspend or terminate accounts violating these Terms or engaging in harmful behavior.

12. Disclaimer of Warranties

The service is provided “as is” and “as available” without warranties of any kind. Shake & Date does not guarantee uninterrupted service, successful matches, or user authenticity.

13. Limitation of Liability

Shake & Date is not liable for:

  • Damages resulting from user interactions
  • Lost data or lost opportunities
  • Emotional distress
  • Indirect or consequential damages

14. Dispute Resolution & Arbitration

All disputes will be resolved through binding arbitration in South Carolina, unless prohibited by law. Users waive their right to participate in class action lawsuits.

15. Changes to These Terms

We may update these Terms at any time. Continued use constitutes acceptance of revisions.
